|The Karnataka High Court on Wednesday directed the Bruhat Bengaluru Mahanagara Palike (BBMP) not to take precipitative action against an apartment complex, built near Arekere, following withdrawal of occupancy certification and sanctioned plan.|
Justice Vineet Kothari passed the interim order on a petition filed by M/s SJR Prime Corporation Pvt. Ltd. questioning the BBMP order of January 1, 2018 cancelling the OC and the sanctioned plan. The civic body had withdrawn the OC and approved plan for around 600 flats based on an order of the National Green Tribunal with regard to maintenance of buffer zone from water bodies.
The BBMP had claimed that the driveway and another portion of the apartment complex come under the buffer zone.
Notice on SWD
The High Court on Wednesday order issue of notice to the BBMP on a petition filed by a couple complaining that the civic body is building a storm water drain (SWD) in such a manner that it would prevent ingress and egress to their property at Kasavanahalli.
Justice Vineet Kothari passed the order on a petition filed by Mahendra Kumar A.R and his wife Roopa, both software professionals.
The petitioners pointed out that the BBMP had in 2016 demolished a portion of their residential building constructed on a 4,650 sq. ft. site before the High Court had in September 2016, in an earlier petition (which is still pending), restrained authorities from causing further damage in the guise of removal of structures from SWDs.
In the present proceedings, the couple pointed out that the BBMP is constructing structures for the drain in such a way that it blocks the entry to their property though the alignment of the SWD is away from their house.
