HC dismisses writ petition on Brahmapuram plant.

A Division Bench of the Kerala High Court recently dismissed a public interest writ petition against the setting up of a proposed waste-to-energy plant at Brahmapuram. The government had submitted that feasibility study had already been conducted.

Dismissing the petition, the Bench comprising Acting Chief Justice Ashok Bhushan and Justice A.M. Shaffique observed that the writ petition was baseless in view of the fact that appropriate measures had been taken by the government while granting sanction for setting up the plant. The petition was filed by T.C. Sajith, vice-president, All India Youth Federation (AIYF), State unit.

The court also observed that the writ petition had been filed without collecting proper materials. This had to be deprecated.

The petitioner had said that the Pollution Control Board had recommended that a new plant should be established after studying its feasibility. He alleged that without conducting the feasibility study, the authorities were going ahead with the construction of the plant.
